Fraud Investigation
Simply put, fraud is a false representation or concealment of a material fact, whereby one party takes advantage of another party, who relied on the falsity, and the second party was damaged in the process.
Not all false statements are fraudulent. When we investigate fraud, we work to determine if the defendant's actions meet all five of the required separate elements:
- A false statement of a material fact;
- Knowledge on the part of the defendant that the statement is untrue;
- Intent on the part of the defendant to deceive the alleged victim;
- Justifiable reliance by the alleged victim on the statement; and,
- Injury to the alleged victim as a result.
I have the knowledge, education, training, and experience to support counsel representing plaintiff (or prosecuting government body) alleged victims or defendant's involved in fraud litigation at the civil or criminal level of the court system.
My expert witness background in the area of fraud investigation includes:
- ADVERSARY COMPLAINT - U.S. Bankruptcy Court against the principals and related facilitators of a securities fraud related ponzi scheme.
- CRIMINAL PROSECUTION - CEO and the CPA auditor of the ponzi scheme by the Securities Division of the Missouri Attorney General's Office.
- CRIMINAL PROSECUTION - Multiple single defendant employee embezzlement cases by the Maricopa County Attorney's Office (Phoenix, Arizona).
- MORTGAGE FRAUD INVESTIGATION - Multiple cases of alleged mortgage fraud against Arizona licensed title companies, escrow officers, mortgage bankers and brokers, lenders, real estate agents, and appraisers.
- COURT APPOINTMENT - Investigation to assess plaintiff allegations of fraudulent behavior resulting in shareholder dispute by the partners.
